Request form for renewing and issuing the latest driving license for 2023. A driving license, also known as a driver's license, can be reissued according to current legal regulations if it is lost or damaged. Lawyers provide consultation, analysis, and introduce some forms to serve the process of reissuing and taking a driving license exam, specificaly:
1. How is the process of renewing a driver's license regulated?
Based on Article 36 of Circular 12/2017/TT-BGTVT and paragraph 2 of Article 2 of Circular 04/2022/TT-BGTVT, the regulations are as follows:
Individuals whose driver's license has expired:

If the expiration is from 3 months to less than 1 year, from the date of expiration, they must retake the theory exam to renew their driver's license.

If the expiration is 1 year or more, from the date of expiration, they must retake both the theory and practical exams to renew their driver's license.
The procedure for retaking the exams is carried out according to the regulations stated in paragraph 3 of Article 19 of this Circular.
Individuals who have lost their driver's license, with either a valid or expired period of less than 3 months, are eligible to have their driver's license renewed. The required documents include:

A request form for renewing the driver's license according to the prescribed template in Annex 19 issued together with this Circular.

The original documents related to the driver's license, if available.

A health certificate issued by a qualified medical facility, except for the unlimited validity for driver's licenses of Class A1, A2, and A3.

A copy of the identification card or citizen identification card or passport with a valid identification number (for Vietnamese individuals) or a passport with a valid period of use (for foreigners or Vietnamese citizens residing abroad).
When coming to renew a driver's license at the Vietnam Road Administration or the Department of Transportation, the driver must submit a complete set of documents, take a direct photo, and present the original copies of the aforementioned documents (except for the copies already submitted) for verification. After a period of 2 months from the date of submitting the complete documents, taking a photo, and paying the fees as prescribed, if the driver's license is not found to be seized or handled by the authorized agencies, and the driver's name is included in the examination management agency's records, then a new driver's license will be issued.
For individuals whose driver's licenses have been lost and expired for more than 3 months, and their names are included in the examination management agency's records, and they are not in cases where the authorized agencies have seized or handled their licenses, after 2 months from the date of submitting the valid documents as prescribed, they must re-take the following contents of the examination:
- For licenses expired from 3 months to less than 1 year, a re-take of the theory examination is required.
- For licenses expired for 1 year or more, both the theory and practical examinations must be re-taken.
The re-examination documents shall be carried out according to the regulations specified in Clause 4, Article 19 of this Decree.
The agency that re-issues the driver's license for lost cases must send a notification to cancel the old driver's license to the relevant agencies. (This provision has been abolished since June 15, 2022, according to Clause 2, Article 2 of Decree 04/2022/TT-BGTVT)
The date of passing the examination shall be recorded on the back of the re-issued (restored) driver's license, based on the date of passing the examination of the old driver's license.
The time for re-issuing the driver's license shall be implemented as for new issuances.
Individuals re-taking the examination and in need of review or registration with driving training establishments for review instruction must pay the review fee as prescribed and are not required to retake the training program.

Note:
(1): This form is used for general cases of reapplying for a new file.
(2): In cases where false statements are made, erasing or distorting information on the driving license, using counterfeit driving licenses or fake driving files, intentionally deceiving to obtain a renewed driving license, besides having the driving license and original file confiscated by the Vietnam Road Administration or the Department of Transportation, individuals must also be held accountable before the law and are not eligible to obtain a driving license within a period of 5 years from the date of discovery of the violation; when there is a need to issue a new driving license, one must study and take the exam as in the case of obtaining a driving license for the first time.
